| dc.description.abstract | ?tilâf Devletleri, I. Dünya Savası sırasında düsmanla isbirliği yapan Ermenileri savas alanı dısında bir bölgeye sevk etmesi sebebiyle Osmanlı Devleti’ni elestirmis ve bu konuda sorumluluğu olanların cezalandırılmasını talep etmistir. Mondros Mütarekesi sonrası ?stanbul’u isgal ettikleri zaman bu konudaki baskıları daha da artmıs, cezalandırma eyleminin acele olarak uygulanması istemisledir. Osmanlı Devleti bu baskılar karsısında daha fazla dayanamamıs, uygun bir barıs yapabilmek düsüncesiyle, Ermenilerin tehcirini gerçeklestiren ?ttihat ve Terakki yöneticilerini olağanüstü bir mahkeme olan Divan-ı Harbi Örfî mahkemesinde yargılanmalarını sağlamıstır. Ancak burada görev yapan mahkeme heyeti, herhangi bir suç unsurunun olup olmadığına bakmak yerine ?tilâf devletlerinin ve ?ttihatçı karsıtlarının isteği doğrultusunda çalısmıstır. Siyasi bir intikam aracı olarak çalıstığı için de bu mahkemelerden verilen kararlar kamu vicdanını son derece rahatsız etmistir. Özellikle Damat Ferit Pasa’nın sadrazam olduğu dönemlerde yapılan yargılamalar, hiçbir hukuk kuralına uyulmadığı için çok ciddi tepkilere yol açmıstır. Bu mahkemede farklı kisiler de görev yapmıs olmakla birlikte, mahkemenin üye ve baskanlıklarında bulunmus olan Süleymaniyeli Mustafa Pasa, zalimane uygulamaları sebebiyle “Nemrut Mustafa” olarak anılmıstır. Bu çalısmada, ?ttihatçıların yargılanma sürecinde veya ceza verilmelerinden sonra, sanıkların suçsuzluğuna delâlet eden bazı örneklere yer vermek suretiyle, yargılamalarla ilgili eksik bilgiden kaynaklanan yanlıs düsüncelerin giderilmesi amaçlanmıstır. | en_US |
| dc.description.abstract | Triple Alliance criticized the Ottoman Empire on the grounds of sending the Armenians who collaborated with the enemy during World War I outside of the war field and requested punishment of those having responsibility for this issue. Further they increased the pressure on this subject and wanted to rush the implementation of punishment when they occupied Đstanbul after Mondros Armistice. The Ottoman Empire could not resist against these pressures, with the idea of making a proper peace, and provided the prosecution of the directors of the Committee of Union and Progress performing the exile of Armenians at the Martial Court ( Divan-ı Harb-i Örfî) , an extraordinary court. However, this court worked at the request of the the Allies and the Unionist opponents instead of looking whether there is any element of a crime. The decisions of this court was extremely uncomfortable for the sense of community. Especially the trials during the periods of Grand Vizier Damat Ferit Pasha collected a very serious reaction for non-compliance with the rule of law. Although different people made the task of this court, Süleymaniyeli Mustafa Pasha, having positions such as membership and presidency, was known as “Nemrut Mustafa” because of his cruel practices. In this study, it is aimed to eliminate wrong ideas arising from incomplete knowledge in the process of being judged of Unionists or after being punished of them, by giving some examples which signifies that defendants are innocent. | en_US |
