| dc.description.abstract | Denetimli Serbestlik Sisteminin uygulama örnekleri İslamiyet'in kuruluş yıllarına kadar dayanmaktadır. Osmanlı ve Cumhuriyet dönemlerinde de benzer uygulamalar bulunmaktadır. Ancak denetimli serbestlik bir ceza sistemi olarak ülkemizde 2005 tarihli ceza kanunları ile uygulanmaya başlamış ve aynı yıl teşkilatlanması tamamlanmıştır. Sistem kuruluşundan beri sürekli değişim ve gelişime uğramıştır. Hukuki, teknik ve teknolojik alt yapının oluşturulmasıyla, savcılıklar ve ceza mahkemelerince verilen hapis cezalarının dışındaki bütün cezaların infazını gerçekleştiren bir kurum haline gelmiştir. Uygulamalar bakımından, sadece kendi iç dinamiklerini kullanmanın yetersiz kalması nedeniyle tüm kamu kurum ve kuruluşlarını da infaz sürecine dâhil edilmiştir. Sistem yıllar içerisinde, toplumu ve mağduru koruyan, tedbir altındaki kişinin ise tüm eksikliklerini gideren bir infaz ve iyileştirme faaliyeti haline gelmiştir. Çalışmamızın ilk bölümünde, sistemin tarihsel süreçteki benzer uygulamaları anlatılarak, mevcut durum ile karşılaştırılması yapılmıştır. İkinci bölümde kurumun idari yapısı incelenmiştir. Üçüncü bölümde mevcut uygulamalar, istatistiksel bilgiler ile yargı ve idari kararlardan yararlanılarak anlatılmıştır. | en_US |
| dc.description.abstract | Applications of probation system can be seen in the early years of Islam. In addition to that Ottoman and Republic period have also same kind of probation applications. However, probation system is established officially at 2005 as part of criminal justice system and organizational structure is completed at the same year. The probation system is changed and developed since its establishment. After legal, technical and technological substructure is completed, the probation system has became such an institution that carrying on all kinds of correction except jail term which is given by criminal court and office of the public prosecutor. In terms of applications of probation uses not only internal sources but also public establishments and organizations capacity. They play critical role in the punishment execution process. The probation system which contains operations of rehabilitation and execution has become such a system that protecting society and victim cover the needs of probationers over the years. First part of this study contains quasi probation examples in history and these examples are compared with current situations. In the second part, the probation systems organizational structure is examined. In the third part, current applications of probation are discussed by the help of statistical data and administrative, judicial decision. | en_US |
